Panas Baran...

assalamualaikum...
untuk sesiapa yang mempunyai sifat panas baran. bole laa gune tips nii..

Pertama : jauhkan diri daripada situasi menimbulkan kemarahan..  
Jika tahu pasangan anda itu mempunyai sifat panas baran, elakkan dari melakukan perkara yang boleh menimbulkan kemarahannya. segera memohon maaf apabila melakukan salah dan akui kesilapan itu. dan bagi tuan diri yang mempunyai sifat baran nii, segeralah menjauhkan diri daripada keadaan tersebut dan mencari masa yang sesuai untuk bertenang...

Kedua : mendiamkan diri ketika marah
Panas baran bermula dengan tindakan demi tindakan. cara terbaik untuk mengelakkan diri daripada baran adalah mendiamkan diri ketika marah. dan sedikit demi sedikit dapat mengurangkan sifat panas baran anda.

Ketiga : belajar menyampaikan kemarahan secara positif dan terhormat.
Perlahankan suara, bercakap menggunakan perkataan yang tidak menyakitkan hati orang lain, dan elakkan daripada bertindak secara fizikal.

Keempat : luahkan pada masa dan tempat sesuai..
Sentiasalah meluahkan emosi dan apa jua masalah yang anda alami pada masa dan tempat yang sesuai. dan jangan pendam perasaan itu..

Kelima : bawa bertenang..
Anda perlu belajar mengawal diri dengan bertenang dalam menghadapi apa jua keadaan dan situasi yang boleh menggugat kesabaran anda. tarik nafas dalam-dalam dan lepaskan. dan sebaiknya beristighfar serta memaafkan orang lain.

Keenam : senyum..
Senyuman mampu meredakan tekanan.. senyuman yang sentiasa terukir di bibir menjadi penawar kepada kemarahan dan sifat panas baran anda.

semoga kita berjaya dapat mengatasi sifat panas baran yang sebenarnya boleh dikawal oleh diri kita sendiri.. hanya untuk share kepada semua teman bukan untuk perli sesiapa okayy... keep smile everyone.. :-)

TORT OF DEFAMATION....

Based on Lord Atkin in Sim v Strectch defined defamation as statements (oral,written,temporary or permanent) which injures the reputations of another by exposing him to hatred , contempt and ridicule or which tends to lower him in the esteem of right -thinking members of society. Defamation also means as divided into Libel (written , permanents or visible form ) and Slander (oral and temporary) ,Libel is actionable per se which is action can be taken without having to prove damage. While Slander is not actionable per se except the imputation of a criminal offence punishable by imprisonment, unchastity or adultery to a women or a girl, certain contagious diseases and disparage the plaintiff in any "office, profession or trade".
Issues arising out of the facts are whether the words complained of Nona Bedah were defamatory,secondly whether the words complained of refer to the plaintiff, Nona Bedah , and finally whether there is a publication to the third party. Each issue shall be discussed in turn.
In the first element the issue words complained must be defamatory , it was held in the case of Hasnul Abdul Hadi v Bulat Muhamed (1978) , the court held that to call a person a liar. " Abu Jahal " , is a defamatory and the words Abu Jahal is actionable per se. And in case Luk Kai Lam v Sim Ai Leng (1978), the court held that to call "prostitute" by the defendant and statement that plaintiff had been sleeping with Sia in the nursing home for over a year before they got married is defamatory.
On the facts of the case Nona Bedah v Wan Jelita that Wan Jelita has stated in Kampung Pisang's bulletin that, " we no longer need a leader who is conservative. We need a new leader who does not need any black magic to retain her position and leadership" , is the defamatory.
It is submitted that based on the ratio in the case of Hasnul Abdul Hadi v Bulat Mohamed (1978) and case Luk Kai v Sim Ai Leng (1978), Wan Jelita had stated a defamotary words to words plaintiff through Kampung Pisang is bulletin as plaintiff was a conservative leader and had use black magic to retain her position as a President in Single Mother Association in Kampung Pisang.
In the second element, the issue words complained of refer to the plaintiff and it must real or imaginary. Based on case Newstead v London Express Newspaper ,the court held that a new item published that " Harold Newstead , a thirty-year old Camberwell man" had been convicted of bigamy. The plaintiff's contention that the words publish could be understood to refer to him was upheld because there are two Camberwell man were resided in the same area.
On the fact, of the case Nona Bedah v Wan Jelita , the statement of Wan Jelita "we know longer need a leader who is conservative" in the bulletin is refer to Nona Bedah because Nona Bedah was a president for 4 years consecutively in Kampung Pisang.
It is submitted that based on the ratio in the case of Newstead v London Express Newspaper, statement of Wan Jelita in the bulletin is understood by all villagers that statement is refers to Nona Bedah and this can damage the reputation of Nona Bedah as a President of Single Mother Association in Kampung Pisang. The defamation of Nona Bedah is under Libel , so she can use the statement in bulletin to take action as a prove to the court.
In the third elements the issue whether there is a publication to the party. Publication means as making non the defamatory matter after it has been written to a few person other than the person of whom it is written. A communication between spouses about a third party is not publication. A statement not heard because made to a deaf person,or in a language not understood, or because it is not obviously referable to the plaintiff is not considered as having published. It was held in case of Theaker v Richardson , the defendant had placed the defamatory letter in the plaintiff's husband letter box in Manila. The jury found the defendant liable because in the circumstances of the case , it was reasonable to expect that the letter would be open and read by the plaintiff's husband.
On the fact of the case Nona Bedah v Wan Jelita, Wan Jelita wrote an article in the Kampung Pisang's stating that "we no longer need a leader who is conservative and does not use any black magic to retain her position and leadership". Wan Jelita is liable defamation because she had publish the article to the public and it is reasonable because every villagers can read the bulletin.
It is submitted that based on the ratio of Theaker v Richardson, Wan Jelita had publish a defamatory statement trough the Kampung Pisang's bulletin which is all members of Single Mother Association can access and my opinion, Nona Bedah have to prove that the post is not right and prove it to the court.
There are defends that the defendant can make on the plaintiff. The defendant may plead under section 10 - Apology where are that the publication was made without malice or gross negligence , a full apology was published at the earliest oppurtunity and compensation has been paid into court.
In this case, Nona Bedah as the plaintiff had suffered a bad reputation due to action of defendant, so , the right shall give to the plaintiff to claim this action as defamatory and plaintiff can take an action on the defendant.
The conclusion is Nona Bedah can claim for defamation as Libel as all three elements of the defamation has been fulfilled.
